Maker terms
In short: you keep the copyright of your work. By uploading, you promise that the work is really yours, you choose a free license (CC0 or CC BY 4.0) for everyone who downloads it, and you allow NonCopyrighted to host, show and share it. If your promises turn out to be untrue, you are responsible, not NonCopyrighted.
Version 1.1, 30 September 2026. These terms apply to every upload and listing on NonCopyrighted.com.
1. Who we are
NonCopyrighted.com is run by Tovation, Industrieweg 43-45, unit 54, 2651 BC Berkel en Rodenrijs, the Netherlands. Chamber of Commerce (KvK) 71947957, VAT NL002417114B43. Contact and single point of contact for users and authorities: contact@noncopyrighted.com (English or Dutch).
2. What these terms cover
These terms apply when you list your work or upload files (music, sound effects, photos, video, fonts, graphics, templates) to NonCopyrighted. By ticking the box in the form and sending your listing, you accept these terms. We store which version you accepted.
3. Your promises
For every work you upload or list, you promise that:
- You made the work yourself, or you own all rights to it, or you have written permission from every rights holder to offer it under the license you choose.
- The work contains no parts of someone else’s work, such as samples, loops, stock footage, fonts, photos or artwork, unless their license clearly allows you to share them again under your chosen license.
- Every recognizable person in a photo or video has agreed to it being shared this way. You can show that agreement if we ask.
- The work does not show logos, brands or protected characters in a way that needs permission you do not have.
- If the work was made fully or partly with AI, you say so in the form and you have the right to share it under the tool’s terms.
- The work is not registered in YouTube Content ID or a similar system in a way that would claim videos of people who use it under your license. If it is, you say so clearly in your listing.
- Offering the work under your chosen license does not break an agreement you have with a label, publisher, distributor or collecting society.
- Everything you tell us about yourself and your work is true.
- You can prove all of this. On request you send us proof within 7 days, such as original project files, raw photos, font source files, signed model releases or the license of any part you used.
4. The license you choose for downloaders
For files you upload to NonCopyrighted, you choose one of two standard licenses:
- CC0 1.0: you give up your rights as far as the law allows. Anyone may use the work for anything, without credit.
- CC BY 4.0: anyone may use the work for anything, also commercially, as long as they credit you.
Read Every free license explained before you choose. Both licenses are permanent: if you later remove your work, people who already downloaded it may keep using it under the license. That is how Creative Commons licenses work, and it protects the people who used your work in good faith.
5. Permission for NonCopyrighted
You keep your copyright. You give Tovation a non-exclusive, worldwide, free permission to store your files, make previews (such as short audio clips, thumbnails, waveforms and font samples), show and play them on NonCopyrighted, make them available for download under your chosen license, and show your work with your name when we promote NonCopyrighted, for example on social media or in a newsletter. This permission ends when your listing is removed, except for copies that are already downloaded or shared, and backups that are deleted in the normal course.
5a. Verification
When you list your work, you upload proof that you made it: screenshots of your own project, such as your music software with all the tracks, your Photoshop or Illustrator layers, your font editor with the glyphs, or your camera raw files. Only our team sees this proof; it is never published. We check it by hand before your listing goes live. If the proof is missing or not convincing, we do not publish the listing. In case of a dispute, we can ask for more proof as described in section 3.
6. Review and removal
We check every listing by hand before it goes live, but we cannot check everything and our check is no guarantee that a work is legal. We may refuse or remove a listing or file at any time, for example after a report from a rights holder. When we remove something, we tell you why by email, unless the law does not allow it, and you can reply to object. You can ask us to remove your listing at any time.
7. Proof we keep
For every upload we store your account, the date and time, your IP address, the version of these terms you accepted, the license you chose and the files. We use this to show who offered the work under which license, if there is ever a dispute. See our privacy policy.
8. If your promises are not true
You are responsible for the works you upload. If someone makes a claim against Tovation or NonCopyrighted because one of your promises in section 3 is not true, you will cover the damage and reasonable costs, including legal costs, as far as the law allows. We will tell you about the claim and give you the chance to help respond. If someone claims rights to a work you uploaded, we may give them your name and email address so they can contact you directly, and we may remove the work until the claim is settled.
9. Repeated problems
If we receive justified reports about your works more than once, or if you knowingly upload work that is not yours, we close your account and remove all your listings.
10. Our liability
NonCopyrighted is offered as it is. As far as the law allows, Tovation is not liable for indirect damage, loss of income or for how others use your work. Our total liability is limited to 100 euros per event, unless the damage is caused by our intent or gross negligence. If you act as a consumer, your mandatory rights under Dutch and EU law stay in place.
11. Changes
We may update these terms. The new version applies to uploads made after the change. We will announce important changes by email or on this page.
12. Law and court
Dutch law applies. Disputes go to the competent court in Rotterdam, unless the law gives you, as a consumer, the right to a court in your own country.
