Privacy policy

This privacy policy explains what personal data NonCopyrighted.com collects, why, how long we keep it and what your rights are. Questions: contact@noncopyrighted.com.

Who is responsible

Tovation, Industrieweg 43-45, unit 54, 2651 BC Berkel en Rodenrijs, the Netherlands, KvK 71947957, is responsible for the processing of your personal data on NonCopyrighted.com.

What we collect and why

  • Contact form: your name, email address and message, so we can reply. Basis: our legitimate interest in answering you.
  • List your work and your account: your name, email address, password (stored encrypted), links to your work, the license you choose and the files you upload. We use this to review, publish and manage your listing and to let you log in at My listing. Basis: our agreement with you (the maker terms).
  • Proof of uploads: for every upload we store the date and time, your IP address, the version of the maker terms you accepted and the license you chose. We keep this to show who offered a work under which license if there is a dispute. Basis: our legitimate interest in protecting makers, downloaders and ourselves.
  • Reports: when you use the report form, we store your name, email address, role and report, to handle it and reply. If a report is about copyright, we may need to tell the maker who made the claim, and we may give the rights holder the name and email address of the maker who uploaded the work, so they can settle it directly. We only share what is needed. Basis: our legal obligations under the Digital Services Act and our legitimate interest.
  • Payments for upgrades: when you pay for an upgrade, PayPal processes the payment. We receive the payment status and amount, not your card details. We keep invoices as long as Dutch tax law requires (7 years).
  • Statistics: only with your consent, Google Analytics measures how the site is used. Logged-in users are not measured.
  • Advertising: some pages show ads from Google AdSense. Google only uses cookies for personalized ads if you consent. You can change your choice at any time through the cookie settings.
  • Embedded media: YouTube, SoundCloud and similar players can set their own cookies when you play something.
  • Security: our host and security tools log IP addresses to protect the site against abuse.

See our cookie policy for all cookies. We do not sell your data.

Who else receives data

We use processors that work on our behalf: SiteGround (hosting), Google (Analytics, AdSense and Search Console), PayPal (payments) and our email provider. Some of them may process data outside the EU; they use the safeguards the law requires, such as the EU-US Data Privacy Framework or standard contractual clauses.

How long we keep it

  • Messages: up to 12 months after we replied.
  • Account and listing data: as long as your listing or account exists, and deleted on request.
  • Proof of uploads: up to 5 years after the upload is removed, because claims can come later.
  • Reports: up to 2 years after they were handled.
  • Payment records: 7 years (legal obligation).

Your rights

You can ask us to see, correct or delete your personal data, to limit its use, to receive it in a common format, or object to its use. Email us and we will respond within one month. You can also file a complaint with the Dutch data protection authority, the Autoriteit Persoonsgegevens.
